Zoning board approves variance for 15-foot above-ground pool and deck on Colonial Drive

The Zoning Board of Appeals approved a variance for a 15-foot above-ground pool and a surrounding deck at a Colonial Drive property after the applicant submitted revised plans addressing earlier concerns about setbacks and safety.

The applicant said the proposal includes a 15-foot above-ground pool and a deck surrounding the pool; they added the deck after prior discussion and submitted the revised plans for the board’s review. "We're building we're looking to build a 15 foot above ground pool," the applicant said.

Board members checked that the revised site plan addressed previous concerns about visibility and railing safety given the property's topography. Staff confirmed the structure would be treated as within a side-yard or front-yard context depending on the lot geometry and that the revised plan showed compliance with setback principles except for the front-yard location, which prompted the variance request.

A board member moved to approve application 24-1619 for the pool and deck as revised, citing that the property has two front-yard setbacks and that the hardship resulting from that lot configuration justified the variance. The member said the variance would not adversely affect public health, safety or welfare as conditioned by the revised plan.

The board voiced "Aye" and the motion carried. The approval applies to the revised plans that were submitted and shared during the meeting; the applicant must obtain any necessary permits and meet building-department requirements before construction.
