Edgewater special magistrate corrects order date, sets Nov. 24 compliance deadline

The special magistrate presiding over a Nov. 14, 2024 City of Edgewater code-enforcement hearing corrected a clerical error in an earlier order and set a new compliance deadline of Nov. 24 for the affected case.

The magistrate opened the hearing, reviewed and approved minutes from the Sept. 12 meeting, and said no members of the public were present; the magistrate also noted there had been no ex parte communications. A meeting participant raised a question about agenda item 6 and said the code-related request had been revised before the hearing and required correction.

A staff member pointed out that "there was a typo in the officer's officer's request. They put the wrong date in, sir," noting the corrected version had been sent to the party. The magistrate then clarified whether a prior compliance date had been set (asking if it had been Aug. 18) and determined a feasible new compliance date was needed because the prior signed order contained a date that had already passed.

"So I'll give them until November 24 to come into compliance," the special magistrate said, directing that the corrected order be signed, mailed and that the oral proclamation be entered on the record to confirm notice had been provided.

With no one present for other matters, the magistrate found the items that met the requirements to be in compliance and found other matters in violation, ordering staff-recommended sanctions for those violations. The magistrate did not announce any formal votes; actions were taken as administrative orders from the bench.

The magistrate concluded by instructing staff to prepare and issue the corrected notice reflecting the Nov. 24 compliance deadline and to proceed with the sanctions the staff had recommended for matters the magistrate found in violation.
