The Danbury Planning Commission on April 15 approved a revised floodplain permit and revised site plan for Danbury Mall LLC to install 10 Rivian EV charging stations at 7 Backus Avenue (F17002, special exception no. 771). Planning staff told commissioners the accessory EV-charging installation requires site-plan approval under local regulations and that the proposed grading is one foot above the Army Corps–reported base flood elevation of 454.5 feet.
Staff (Ali) said the site is in the floodplain by area but outside it by elevation because the project’s finished grade will be 1 foot higher than the cited base elevation; the proposal does not reduce overall parking. Commissioners asked whether nearby Tesla chargers are at similar elevations; staff said Tesla chargers are outside the elevation area while the asphalt and the proposed Rivian chargers are within the floodplain area but outside by elevation. The commission voted to approve the revised floodplain permit with standard conditions, noting engineering certification and compliance with the floodplain permit conditions will be required.
The approval was recorded by voice vote; staff said any required certifications and final as-built elevations must be provided per the floodplain permit conditions before final acceptance.
