Planning board approves fence variance at 202 Hubbell Street despite staff opposition

The City of Edgewater Planning & Zoning Board voted April 15 to approve variance VA2605, allowing a 6-foot fence on the property line at 202 Hubbell Street in place of the 10-foot side/corner yard setback required by the local code.
The variance was introduced by the chair and reviewed by Development Services staff, who said the application was evaluated against Article 3, §21-3802(d) and Article 9, §21-1004(d) and that the applicant had not met all six criteria for a non-administrative variance. "City staff do not recommend approval," the Development Services Director told the board during the staff report.
Applicant Thaddeus Hardy, who identified himself and gave an address, told the board the fence is sought primarily for privacy and safety: to screen stored items such as a boat, to keep pets and children secure, and to align the fence with an existing window on the house. "For privacy and also to, I guess, also to the neighborhood," Hardy said in explaining why the fence was needed.
A board member who inspected the site described the proposed fence location as outside the visibility triangle and said the house placement made the privacy argument persuasive. "I can understand the privacy issue," the member said while discussing the property's layout.
After public comment closed, a committee member moved to approve VA2605 as presented and another member seconded. The motion carried on a roll-call vote of members present.
The approval allows the fence to be placed on the property line as requested. The board did not attach conditions beyond those in the approved variance, and staff will record the variance per city procedures. The meeting adjourned after completing the evening's agenda.
