Board approves variance allowing detached garage in side yard for Green homeowner

The City of Green Board of Zoning Appeals voted unanimously Jan. 15 to grant a variance that will allow Clifton Stadler to construct a detached garage in his side yard rather than the rear yard required by code.
Stadler told the board he must place the garage at the side-yard location because a septic leach field lies behind his house and would be disturbed by a rear-yard structure. "I have a shed there now ... and I wanted to replace it with a garage," Stadler said during sworn testimony, showing maps and photos of the site. Summit County Public Health and the building and zoning inspection report in the meeting packet indicate the permitted rear location would overlap the leach field.
Board members asked questions about alternatives and construction impacts. A board member asked for a simple explanation of a leach field; Stadler described the septic system and tile field that disposes wastewater into the ground, noting the leach-field pipes run under the rear yard.
A motion to grant the variance was made and seconded; the roll call recorded three votes in favor and the motion passed 3–0. The board chair advised Stadler to follow up with the zoning department to obtain the required building permit.
The variance references Green codified ordinance chapter 157 and table 157.087-1 concerning allowed accessory uses; the board relied on submitted inspection documentation and site constraints in reaching its decision.
The board moved on to two additional sign-and-fence variance requests after the vote.
