A Norway resident, introduced to the council as petitioner Darren Massey, asked March 2 for permission to pave a gravel driveway that runs along a sewer utility easement.
Staff told the council the utility typically cannot accept the long-term liability of structures built over an easement and that, while the city could agree to allow improvements, it would usually require conditions about who would pay to restore pavement if the city later needed access for repairs. The city attorneyreview requested changes to any agreement and staff said zoning/permit authorization from the township (the property is outside city zoning jurisdiction) would be required before a paving approval could proceed.
Petitioner Massey described persistent seasonal washouts and silt buildup on the driveway and said hewould prefer paving rather than repeated gravel maintenance. Councilmembers raised alternatives such as relocating the driveway on the property to avoid the easement, asked whether the water line also conflicted with the location (staff said only the sewer line runs there), and urged Massey to obtain contractor estimates and discuss options with staff and counsel.
Council took no final action and asked staff and counsel to draft any potential agreement language and cost/repair terms if the petitioner wishes to proceed. The petitioner said he would obtain quotes and return with more detailed placement and price information for council consideration.
