Justin Bracco, who identified himself as living at 13 Pocono Road (also known in the filing as 19 Pocono Point Road), told the board the addition would be built over an existing patio and would not extend beyond the house’s furthest wall. "We're here just to request the variance," Bracco said, explaining the request is driven by "an undersized lot" created by a preexisting house built in 1960.
Board member Rivas moved to approve the application, describing the relief sought as a reduction of the westerly side-yard setback from 40 feet to 12 feet and an increase in maximum building coverage from 15% to 19.5%. "The reason I am approving this application is the hardship differs in kind from hardships imposed by the regulations and other properties," Rivas said, citing the lot’s preexisting condition and noting the property is in an R-80 zone.
