Board grants 39-foot-6-inch rear-setback variance for Lyndale Circle homeowners

On May 15, 2025, the Green Board of Zoning Appeals voted 3-0 to grant Douglas and Victoria Husser a 39-foot-6-inch rear-setback variance to permit a roughly 20-by-20 family-room addition at 2375 Lyndale Circle.

The chair described the request as a variance to Green codified ordinance chapter 157, specifically section 157.101-1, allowing an addition to be constructed 20 feet 6 inches from the rear property line where a 60-foot setback is required. Chair said the house was originally built in 1966 and that lots on Lyndale Circle have existing, nonconforming setbacks, which factored into the board’s consideration.

"My wife and I are planning on adding a family room addition to the rear of our building," appellant Douglas Husser said, explaining that the house layout and a rear entrance make that location the most practical connection and that the grade at the front of the lot makes moving the addition forward impractical. He described the project as roughly 20 by 20 feet.

Chair read a written letter from neighbors Joel and Serena Cochran that stated, "Since our backyards are joined ... we have no objections to the variance requested," and noted no other neighbors objected during the hearing.

Board member Mister Spade moved to grant the variance; Mister Awadallah seconded. The clerk called the roll and recorded yes votes from Mister Spade, Mister Awadallah and Mister Incravati; the motion passed 3-0.

The board did not place additional conditions on the variance at the hearing. Chair wished the Hussers luck with the project; the board did not state any further administrative deadlines or appeals at the meeting.
