EIC debates soil-management and DEEP caveats for Great Pasture Road project; adds inspection and reporting conditions

At the March 12 meeting the Environmental Impact Commission reviewed regulated activity 12282 for a site on Great Pasture Road and discussed extensive erosion-control, soil-management and DEEP (Connecticut Department of Energy and Environmental Protection) filing requirements before taking final action.
Applicant representative Benjamin Dodo said the staff report covered items discussed at earlier meetings and that the project will follow a soil-management plan with special conditions for environmental and soil handling. Commissioners asked for clarity on inspection frequency and what constitutes a rain-trigger for additional inspections. After discussion the commission agreed to add a condition that requires inspections triggered by any rainfall event of half an inch or more in 24 hours in addition to the required weekly inspections, and to require a qualified environmental professional (LEP) to prepare monthly reports during construction.
Commissioners also asked that the record reflect Connecticut DEEP remediation-site rules (ELOR) and that any temporary non-emergency release must be approved by DEEP and recorded with the Danbury city clerk. They added conditions prohibiting placement of contaminated or polluted media within existing wetlands or mitigation areas unless DEEP authorizes the reuse and filings are recorded as required by state regulations.
The commission discussed whether to vote that evening or wait for the applicant’s LEP to comment; the applicant and staff agreed to work with the LEP and return language to the commission for condition finalization. Staff said it will add the clarified inspection trigger (half-inch) to the project conditions and document that DEEP‑related filings must be recorded with the city clerk.
