Ontario council approves formation of Community Facilities District No. 71 (Newhouse Phase 2) and levies special tax

The Ontario City Council approved a package of actions to establish Community Facilities District No. 71 (Newhouse Phase 2), approve special taxes and bonded indebtedness, call a special election, and later declare election results showing all ballots in favor.

City staff told the council that notice of the hearing had been provided under the Mello–Roos Act and that no written protests were received. The County of San Bernardino Registrar of Voters certified that no registered voters reside within the proposed district territory, a typical outcome for some new residential CFD territories.

After the hearing the council voted to adopt resolutions creating the City of Ontario Community Facilities District Number 71 (Newhouse Phase 2) and setting an appropriations limit and to deem it necessary to incur bonded indebtedness. Council then approved a resolution calling a special election for the district.

The assistant city clerk opened three ballots and announced that all three were in favor of forming the CFD. The council then adopted a resolution declaring the election results and directing recordation of the notice of special tax lien. The council also read the connected ordinance levying a special tax for CFD No. 71, waived further reading and approved the ordinance on an electronic vote of 4–0 with Council Member Wapner absent.

Council members who moved and seconded the motions were recorded in the meeting minutes; several motions passed by electronic vote, recorded as four yes votes with one member absent. The action establishes the district for Newhouse Phase 2 and authorizes the special tax and bonded indebtedness mechanisms to fund public facilities identified in the district report.
