County legal counsel summarized mediation results for the board: "The terms are $300,000, which includes any damages to the trees that were done before," counsel said, describing the settlement's scope, which also uses the plaintiff's replanting plan and allows the county to move forward with the project without the risk of further permit appeals.
Construction timetable and additional costs: County engineering staff said physically implementing the design will depend on weather and equipment availability; the county engineer estimated the construction window will likely be two to four months once conditions allow and noted certain downstream relief would be optimized if the board also approves construction of a berm previously recommended by staff. Staff estimated planting and material costs at roughly $230,000 (not including in-house labor and equipment) and the berm/structure work at about $148,000 (also exclusive of in-house labor).
Board direction: Commissioners approved the settlement and asked staff to advance budgeting and planning for the berm and revegetation work, and to continue community engagement to explain upstream removals and downstream benefits.
