The Middletown Planning & Zoning Commission on June 10 approved a two‑lot subdivision for a 7.114‑acre property at 109 Old Road Drive (S‑2026‑3).
Attorney George Law, representing applicants Brian T. Cronenberger and Lena Cronenberger, told the commission the proposed lots would be about 3.927 acres and 3.187 acres and that the Middletown Zoning Board of Appeals granted a variance on Dec. 10, 2025 allowing subdivision without road frontage. "The proposed lots are 3.927 acres and 3.187 acres," Law said, and noted that revised page twos of the subdivision map include additional soil testing.
Why it matters: the property fronts on a private easement (Old Lane Road), meaning the subdivision depends on documented access rights and satisfactory septic/well approvals. Law said title searches show recorded deed language granting ingress and egress to all lots that use the private road; commissioners nonetheless asked for explicit deed or easement language to be included before final recording to reduce future ambiguity.
The health department submitted revised comments approving a preliminary septic design and identifying a reserve area for the existing house; staff said the department will require final septic review before any building conversion. Staff also told the commission that outstanding public‑works comments and any Mylar changes should be resolved prior to final map recording.
