Alameda County Planning meeting continued after counsel says Brown Act posting failed

County counsel told the Board of Supervisors' Planning meeting on Feb. 20 that links to agenda attachments were lost and the 72‑hour Brown Act requirement was not met; the board agreed to continue agenda items, including consent items 4–6, to the March 13 meeting.
President Halbert called the Alameda County Board of Supervisors Planning meeting to order Feb. 20, 2025, but county counsel advised the board that agenda attachments had not been properly accessible online and recommended postponing all agenda items until the next Planning meeting on March 13.
“ We discovered this morning that there was an issue with the access of the public to the attachments that are included with the agenda that was posted,” County Counsel said, describing a loss of active links after the agenda was posted and concluding the county had not met the Brown Act requirement to make agenda materials available 72 hours in advance. “ Our recommendation is that you continue all of the items on the agenda to your next board planning meeting, which I believe is March 13.”
President Halbert agreed and said the county would defer formal actions, including approval of minutes listed on the consent calendar (items 4, 5 and 6), until March 13. He told the public that, for this meeting, the board would accept only non‑agendized public comment and that those matters would also be continued for formal consideration at the later meeting.
The decision to continue items was made in response to a procedural posting error rather than on the substance of any agenda item; County Counsel characterized the recommendation as necessary to preserve compliance with the Brown Act. The board did not take votes on the substantive agenda items during the Feb. 20 session.
The next Planning meeting is scheduled for March 13, 2025, when the continued items are to be taken up.
