Board grants variance to Charlene Atha to rebuild detached garage in side yard

The City of Green Board of Zoning Appeals voted to grant a variance for Charlene Atha that allows a detached accessory garage to be sited in the side yard at 198 East Comet Road.
Atha told the board the property's original garage—built in the 1930s—was torn down after becoming structurally unsafe and she needs a new garage. "We had a garage that was built in the 1930s, and it was... starting to fall down, so we had to completely demolish it and take it out," Atha said. The proposed replacement will be smaller than the old building (about 24 by 20 feet, she said) and assembled from metal panels she said will match the house colors.
Board members asked whether the garage could be sited behind the house. Atha said it cannot because of an on-site septic tank: "The septic tank is behind the house," she said. The request cited noncompliance with GCO chapter 157 (planning and development code), specifically the table limiting accessory uses and locations.
A board member moved to grant the variance and the motion passed on roll call. The clerk recorded affirmative votes from Mr. Spate, Mr. Awadala, Ms. Newbert and Mr. Schultz; the board chair announced, "Your request for a variance passes" and told Atha she was "all set."
