City attorney updates council on Lennar appeal, All Florida mediation and SB 180 lawsuit

City Attorney Wolfe provided a litigation update to the Edgewater City Council on Oct. 6, briefing members on three active legal matters: the Lennar final‑plat appeal, an upcoming mediation in the All Florida Plumbing case, and a newly filed challenge to SB 180.
Wolfe told the council that the Lennar appeal — an appeal of a denied final plat for Edgewater Preserved Phase 2 — had its final hearing on Sept. 25; both sides presented argument based on briefs and the judge took the matter under advisement and will issue a final order at an unspecified date.
On the All Florida Plumbing matter, Wolfe reported a mediation is scheduled for the coming Friday; if an agreement is reached it would be brought back to the council for a vote on whether to resolve the matter.
Wolfe also summarized the SB 180 lawsuit filed Sept. 29 in Leon County. Edgewater is one of 25 plaintiffs (2 counties and 23 cities) named in a roughly 45‑page complaint alleging six counts. Wolfe said count 5 claims SB 180 conflicts with the Community Planning Act and count 6 alleges it violates local governments’ home‑rule authority. Wolfe described the complaint as asserting that sections of SB 180 prevent local governments from exercising planning and zoning powers conferred by the Florida Constitution and statutes.
Wolfe said the next procedural steps are issuance of summonses to defendants and service of the lawsuit; he committed to updating the council as developments occur.
The briefing did not include new court rulings; councilmembers thanked Wolfe and asked for continued updates as litigation moves forward.
