Law director seeks council approval to release a small-market defendant from national opioid MDL

City law director told the Public Safety Committee that national and local counsel reviewing the multi-district opioid litigation asked the city to release one defendant from the MDL. "They have asked us to release Henry Schein as one of the named defendants," the law director said, explaining discovery showed the company's market-share contribution to the case was very small (reported at about 0.03%) and counsel did not plan to pursue the defendant further.
The committee did not object and the resolution (2025-R64) was set for first-reading passage to allow the city's national counsel to proceed with settlement reporting to the court.
What's next: The committee will recommend first-reading passage during the pending regular council meeting so national counsel can move forward with negotiated settlement steps and filings.
