Board approves HOA pavilion variance at Devon Hall Way recreation area

The Board of Zoning Appeals approved a variance (V-24-0010) to permit two covered pavilions at the Shake Ragg community recreation area at 7220 Devon Hall Way to encroach a total of 860 square feet into the 100-foot setback from adjoining property lines.
Alan Guerra, Planner II, told the board the parcel is 5.51 acres and that the recreation area—including tennis and basketball courts, a pool and accessory structures—was developed more than 30 years ago, before the 100-foot setback requirement. Staff said the proposed covered pavilions would have minimal visual and noise impacts and would enhance organized viewing and gathering for residents.
Sylvia Cohn, treasurer of the Shake Ragg Homeowners Association, described a shortage of indoor gathering space for community events and said existing greenery provides a screen between amenities and neighboring properties. Nearby resident Dimitri Donkoff said he supported the project but asked for assurance that recently removed trees would be replanted and maintained; the board and staff said private HOA commitments could not be enforced as city conditions.
Committee member (S3) moved to approve the staff recommendation with the conditions described in the staff report limiting encroachment dimensions; the motion passed.
