Board grants fence-height variance to Green homeowners citing pet containment

The Green Board of Zoning Appeals unanimously approved a fence-height variance on Sept. 19 allowing Michael and Lillian Kowalski to install a 4-foot fence along the property's second frontage on Ponderosa Trail, less than 20 feet from the property line.
Michael Kowalski, the property owner, said he and his wife have two large dogs and need a 4-foot fence to keep them safely inside their yard. He told the board the neighborhood homeowners association had already approved the request and that the proposed fence would be set back from an easement and would leave a narrow service path between adjacent fences.
Board members confirmed setbacks and easements and noted neighboring properties have similar 4-foot fences in the rear. After discussion, a board member moved to grant the two-frontage fence-height variance as requested; the motion was seconded and passed on a 3–0 roll call.
The board did not attach additional conditions beyond standard setback and permit requirements.
