The Green Board of Zoning Appeals voted to grant a 2.13-foot rear-setback variance on Sept. 18 to allow a 21-by-14-foot covered patio at 2304 Glen Ross Drive to be built 12.87 feet from the rear property line, where the city code requires a 15-foot setback.
The chair of the board introduced the application and described the code section in question (Green codified ordinance chapter 157, table 157.101-1). A presenter for the appellant explained the lot backs onto community property and a pond and said the proposed covered patio would not encroach on neighboring private yards.
Board members questioned the applicant about the size and placement; one member noted the request amounts to roughly a two-foot reduction from the required setback. After discussion, a committee member moved to approve the variance and a second was recorded. The clerk called the roll and the motion passed 4–0.
The board emphasized that each variance is decided on its own merits and that the small dimensional departure and the site’s buffer to the rear supported approval. The board did not impose additional conditions beyond standard permitting requirements.
The applicant may proceed with permits consistent with the variance; any construction remains subject to applicable building and permitting reviews.
