Board approves 16‑month extension to wholesale wastewater agreement with Hudson Oaks

The Weatherford Municipal Utility Board voted to approve Amendment No. 2 to the wholesale wastewater service agreement with the city of Hudson Oaks, extending the contract by 16 months through October 2026.

Rick Schafer summarized the item: the original contract took effect July 1, 2023; it included two one‑year extension options, and the proposed amendment formalizes a 16‑month extension executed by the Hudson Oaks city administrator. Schafer said Hudson Oaks had held a special city council meeting to approve the amendment and the signed document was included with the board packet.

Schafer said Hudson Oaks has submitted a discharge permit application to the Texas Commission on Environmental Quality but "it has not been approved yet." He said the contract contains a monthly capacity limit and a penalty mechanism if that limit is exceeded; "we have had to implement that, I believe, twice," Schafer said, noting such exceedances typically occurred in high‑rainfall months.

Board members asked whether Hudson Oaks is complying with contract contingencies and whether the extension timeline is realistic, given the permit and construction work Hudson Oaks is completing (lift station and pipeline). Schafer said staff receives quarterly reports from Hudson Oaks and that construction contracts for Hudson Oaks' lift station and pipeline are underway with an anticipated connection in October 2026.

Tom Novak moved to approve Amendment No. 2 as presented; Ken Davis seconded and the motion carried.

Staff said they will continue to monitor Hudson Oaks' permit status and monthly flow reports and enforce contract terms should capacity exceedances recur.
