Board approves Winston’s request to keep accessory structure with 1-foot side setback

The Green Board of Zoning Appeals on May 21 approved a right-side setback variance that permits an existing accessory structure at 1584 Briarwood Way to remain with a 1-foot side setback instead of the required five feet.
Owner Steven Winston told the board the structure was built with an approximately 1-foot right-side setback rather than the 5 feet required by the permit and that it does not interfere with drainage, utilities, visibility or neighboring properties. “Requiring removal or relocation of the structure would create a significant financial hardship,” Winston said.
A board member moved to approve the 4-foot variance to permit the accessory structure to remain as constructed; the motion was seconded and the roll call recorded Schultz — yes; Spate — yes; Awadallah — yes. The chair announced the motion passed 3–0.
The clerk said Winston would receive a mailed letter and staff would coordinate with the zoning inspector to close out the permit.
The board moved to its next agenda item after the approval.
