Commission approves regulated-activity permit 12:38 with 15 conditions, adds fee for three compliance inspections

The Danbury Environmental Impact Commission approved a regulated-activity permit identified in the meeting as 12:38 on May 28, voting to accept the staff-recommended conditions and adding a requirement that the applicant pay the fee for three compliance inspections.

The applicant's representative, Dynas Vervicas of Artel Engineering Group, told commissioners the applicant "is amenable to the conditions, suggested," and asked the commission to favorably consider the application. Staff member Larry told the commission that Public Utilities and Aquarion have confirmed a previously referenced on-site well is "abandoned" and requested the word "abandoned well" be placed on the final construction map. Commissioner Jeff asked whether the well had been properly capped and filled; Larry said he had been told the well "has already been officially abandoned" and that it had been capped and filled with cement.

Commission discussion corrected several numeric errors in the staff report during the meeting: the wetland-loss area was amended from 505 square feet to 1,505 square feet, and an applicability item originally marked "not applicable" was changed to "yes." Commissioners also confirmed that 15 conditions would apply to the approval; the added 15th condition requires the applicant to pay the compliance-inspection fee to cover three inspections, with staff to address any additional inspections if needed.

A motion to approve the permit, including the corrected staff report and the added compliance-inspection requirement, was made and seconded and carried by voice vote.

Next steps: staff will finalize the construction plan language to reflect the "abandoned well" notation and will document the inspection schedule and fee arrangements with the applicant.
