Commission recommends code amendment requiring a bypass lane for new drive‑throughs

Planning staff presented a proposed amendment to the land development code that would require a dedicated bypass lane at new drive‑through facilities so a vehicle is not trapped once it enters the queue. "The amendment would require a dedicated bypass lane so that vehicles are not trapped once they enter a drive through queue," staff said.

The amendment would apply to new drive‑through facilities and to existing facilities only when substantial changes are made to the drive‑through layout, stacking area, or circulation pattern; it would not apply to routine resurfacing or maintenance that does not change layout. Staff recommended council approval.

Commissioners discussed how the rule should apply to dual drive‑through lanes and whether the code could be interpreted to require a bypass lane for each drive lane. One committee member urged clarity so future applicants would not be required to provide duplicate bypass lanes per drive lane. Planning staff agreed to clarify the language to indicate a single bypass lane per site is sufficient, while leaving the code able to require additional modifications if specific site conditions warrant them.

The commission voted to recommend the amendment to city council with the addition specifying the intention that one bypass lane per site is required. A public hearing on the amendment is scheduled in July before council will consider final adoption.
