The Howard County Board of Appeals held a work session Dec. 19, 2024, during which Chair Gene Ryan said the board had reached the substantive stage of rewrites to its rules of practice and procedure and tentatively scheduled a public hearing for Jan. 30, 2025, to take public testimony and feedback.
The meeting opened with a motion to approve the minutes of the Dec. 5 hearing; the motion was moved by Miss Faircove, seconded by Miss Phillips and carried on roll call. Chair Gene Ryan announced the motion carried and the minutes were approved.
Why it matters: the draft rules cover how the board handles notices, who may sit on cases, ex parte communications and case-status terminology. Board members said resolving inconsistent terminology and editorial issues now will make the draft easier for the public and the Office of Law to review during the legal sufficiency check the board plans to request.
Key changes and clarifications - 'Hearing authority' replaced by 'Board of Appeals' where needed: Members agreed that the term 'hearing authority' in county code applies narrowly to some land-use matters and could create ambiguity if used in the rules; the board directed staff to substitute 'Board of Appeals' so the rules apply uniformly across case types.
- Alternates pool: The board clarified language to require that alternates come from an existing pool of appointed alternate members 'currently serving a term as an appointed alternate member,' rather than being appointed ad hoc when an absence occurs. The board discussed that the county council appoints that pool and the chair would select from it when a regular member is absent.
- Define 'inactive' vs. 'pending': To avoid using 'pending' with two meanings, the board proposed adding an 'inactive' status for matters that are pending in a court of law and therefore not actionable by the Board of Appeals until the court acts. Staff will draft a precise definition for later review.
- Replace 'county solicitor' with 'board's legal advisor': To be consistent and to describe the function rather than a specific office holder, members agreed to use 'board's legal advisor' in multiple sections and to remove inconsistent phrasing about who drafts or provides legal memoranda.
- Postings and timing: The chair flagged an internal inconsistency between a general instruction to post hearings 'as soon as possible' and later text that prescribes a specific posting deadline. Staff was asked to reconcile the timelines and numbering so the public-facing version is clear.
- Postponement for vacations: The board debated whether a litigant's vacation should justify postponement. Members agreed to language that allows postponement when a vacation was scheduled before the hearing was set and virtual attendance is impractical; the aim is to avoid delay tactics while allowing reasonable accommodations for litigants.
Process and next steps Chair Ryan said the board would send the consolidated draft to the Office of Law for a legal sufficiency review and request a return date so the board can consider the Office of Law's comments together with public testimony after the Jan. 30 hearing. Staff indicated the Office of Law will need time to review; the board acknowledged the review will feed a subsequent work session and possible revisions.
Formal action at the meeting - Approval of minutes (Dec. 5, 2024): Motion to approve carried on roll call (moved by Miss Faircove; seconded by Miss Phillips). The chair announced the motion carried.
What the board did not decide The board did not adopt final rules at this session. Members agreed on wording and direction for staff and asked for legal sufficiency review and public comment before returning for further deliberation.
