Council adopts zoning and fee ordinances to implement affordable-housing settlement

The Burnsville Borough Council on March 9 adopted two ordinances tied to the borough’s fourth-round affordable housing settlement and approved several related resolutions.
Council adopted ordinance 20-26-2041, described during the hearing as zoning required by the borough’s settlement with Fair Share Housing Center. Council members voted unanimously on the final reading to adopt the ordinance, and the mayoral chair and staff said redevelopment agreements are anticipated for three new affordable housing sites that will supersede portions of the ordinance where redevelopment plans apply.
The council also adopted ordinance 20-26-2043, which repeals and replaces chapter LD-13 (affordable housing) of the borough land development regulations and updates development-fee rules based on the Department of Community Affairs (DCA) model ordinance. The chair said the ordinance aligns local regulations to the DCA model and development-fee framework.
Earlier in the meeting, the council considered ordinance 20-26-2040 (affordable housing set-asides and amendments to article LD-13) but a council member noted the item had been superseded by the DCA model ordinance; the motion to adopt 20-26-2040 failed on roll call.
The council then moved and adopted resolutions 26-51, 26-52, 26-53, 26-71 and 26-72 en bloc; the clerk will file the ordinances and resolutions with the court by the March 15 deadline. No additional votes or amendments were recorded during the meeting on these ordinances beyond the final readings and roll-call votes reported on the record.
