Board grants Viva Italian Kitchen Pizza Bar license with outdoor–enclosure condition

The Howard County Alcohol Beverage Hearing Board granted a Class B beer, wine and liquor seven-day on/off-sale license to Viva Italian Kitchen Pizza Bar on Dec. 9, subject to a condition that the restaurant enclose its outdoor patio before any alcohol is served outdoors.
Applicant Luigi Palma Esposito told the board he operates two other Howard County restaurants and one in Baltimore and said he plans hours roughly 11 a.m. to 10 p.m. Sunday to Thursday and 11 a.m. to 11 p.m. Friday and Saturday. "Based on the other restaurant, I will be as under 20% [of sales from alcohol]," Esposito told the board when asked about alcohol's share of gross receipts.
Board members probed past violations at a different location in 2008 and 2012; Esposito acknowledged administrative lapses and an early-license confusion and said he took corrective measures. The board then moved to approve the application with the explicit contingency that the applicant provide evidence that the outdoor area is enclosed before alcohol is served outside. The motion carried unanimously; the applicant waived the right to appeal at the hearing.
The board’s approval allows Viva Italian Kitchen Pizza Bar to open a third Howard County location, subject to the enclosure requirement and standard license conditions.
