Mike Hayes said the city calculates the UP fee using a five‑year enrollment projection supplied by MCPS and that the fee is assessed at final site plan when a new residential project would push a school beyond 105% projected capacity.
Hayes explained how the fee works: the fee is assessed per dwelling unit at final site plan, must be used for permanent capital improvements that expand school capacity (not temporary modular classrooms), and must be encumbered within eight years or refunded to the current property owner. Staff noted the fee can materially add to per‑unit costs (staff cited approximately $3,500 per unit after recent adjustments) and that removing the fee can affect housing affordability and project feasibility.
Planning staff reviewed several pipeline projects (including Lake Forest Mall redevelopment accounting for about 1,600 units) and said MCPS has incorporated those pipeline numbers into its projections. The Stevens and Metcove (Metcove Stevenson) applicant requested removal of its assessed UP fee after updated projections dropped Quince Orchard High School out of the triggering tier.
Jasmine Forbes (planning staff) summarized the project's entitlement history and the prior per‑unit fee calculations, noting the final site plan previously set a per‑unit payment (which had been adjusted downward in a 2025 amendment). With the latest MCPS FY‑27 draft programming memo indicating Quince Orchard High School would no longer exceed the threshold, staff supported the applicant's request.
The council moved to adopt the resolution to remove the UP fee for the Stevens and Metcove/Metcove Stevenson project; the motion carried 3–0. Staff also advised that the city will continue to perform adequate public facilities review and retain a 150% moratorium threshold in the ordinance for extreme overcrowding scenarios.
