Special Magistrate Lonnie Groot found that Florida Cocoa Beach Rental LLC failed to obtain a required vacation rental registration for 5350 Ocean Beach Boulevard, Unit 201, and ordered the respondent to obtain the registration by Aug. 7.
Danielle Crawford of City Code Enforcement presented a timeline of enforcement steps: a courtesy door hanger (Feb. 20), a warning citation (March 13), a notice of violation (May 4), a business tax receipt obtained June 21, and a certificate of use obtained June 24. Crawford told the magistrate that the registration could not be completed because the Florida Department of Revenue certification had not been uploaded to the registration application, while third-party listings showed the unit was actively offered for rent.
Magistrate Groot said there was "no evidence to the contrary" presented and directed compliance by Aug. 7. The magistrate specified that the penalty amount for the failure to register will be determined at a subsequent Massey hearing for this case.
No representative for Florida Cocoa Beach Rental LLC or registered agent Tony Springer appeared in the hearing to contest the city's presentation. The magistrate noted that a written order reflecting the compliance deadline and the pending penalty determination will follow.
