Merrimac Conservation Commission to send letters on multiple alleged violations, continues Wallace Boat Yard hearing

At its Oct. 23 meeting the Town of Merrimac Conservation Commission continued a Notice of Intent for Wallace Boat Yard and directed staff to pursue information and compliance at several sites where possible violations were reported.
The Commission continued the Wallace Boat Yard hearing at 103R River Rd. after applicant George Lay requested an extension to complete paperwork. The board voted unanimously (4-0) to continue the public hearing to the next scheduled meeting.
On alleged violations, the Commission agreed to send a letter to the owner or responsible party at 12 Merrimac Square asking for a progress update and set a two-week deadline for installation of erosion control measures. The board also discussed a reported dock at 97 River Rd. that may lack required filings and a Chapter 91 license; Vice Chair Greg Hochmuth was asked to draft a letter seeking permit information and Conservation Agent Jay Smith was asked to check with the Massachusetts Department of Environmental Protection.
Regarding 84 River Rd., the Commission directed Agent Jay Smith to send a letter describing the violation and reiterating rules for work in resource areas; the minutes indicate the letter will state that no enforcement action will be taken at this time. The Commission unanimously approved a warrant to pay expenses related to a computer malfunction.
Informal business included work to update the town's list of engineers and environmental consultants, with Agent Smith tasked to assemble a revised list incorporating local firms and suggestions from Vice Chair Hochmuth, and a plan to prepare an 'Administrator permit' document for submission to the next Town Meeting.
The Commission approved the minutes of Sept. 25, 2024 with minor clerical changes by a unanimous vote and set its next meeting for Nov. 25, 2024 at 6:00 p.m. Chair Jerome Mathieu moved to adjourn at 8:03 p.m.; Vice Chair Greg Hochmuth seconded and the motion passed unanimously.
