Merrimac Conservation Commission approves two Certificates of Compliance, directs enforcement at 25 River Rd.

Jay Smith, the commission’s conservation agent, told members that paperwork and site visits supported issuing a partial Certificate of Compliance for restoration work on Abbey Road (DEP# 45-261) requested by Todd Fitzgerald. The commission voted unanimously, 5-0, to approve the partial Certificate of Compliance.
The commission also voted unanimously, 5-0, to issue a Certificate of Compliance for work at 6 High St. (DEP# 45-279) after Smith described a site visit and confirmed required documents had been submitted for John Cormier’s project.
Commissioners discussed a reported violation at 25 River Road attributed to Paul Chang. Chang did not attend. The commission asked Smith to prepare and issue an Enforcement Order that sets a deadline for installing erosion-control measures and requires filing a Notice of Intent; the minutes do not specify the compliance deadline.
In old business, the minutes state that Robert Prokop’s tree‑planting request at the Lake Attitash boat ramp was denied and that Prokop had not received state permission to plant. The commission agreed to add Todd Schell’s proposed work at the Louise Mills building in Town Square to the next agenda for review of engineered plans.
Sandy Vender, representing the Open Space Committee, asked the commission to sign a conservation restriction for a parcel of Town Forest land. The commission agreed to sign the document and to place an item on the Selectmen’s agenda asking who will be responsible for trail clearing and brush removal on the parcel.
An item listed as “Administrator Permit” was tabled to the next meeting. The commission also voted to change its schedule: the November and December meetings were moved to Nov. 25 and Dec. 16 (Mondays), and future meetings will be held on the fourth Monday of each month at 6:00 p.m.
The commission approved the minutes of the meeting with minor clerical changes (motion passed unanimously) and adjourned after a motion by Chair Jerome Mathieu that was seconded by Mr. Hochmuth.
The minutes list the next meeting as Oct. 23, 2023; that appears to be a typographical error in the record. Given the meeting date is Sept. 25, 2024, the likely intended next meeting date is Oct. 23, 2024. The minutes do not provide additional scheduling details.
