Merrimac Conservation Commission continues River Road hearing, issues compliance certificate and grants one-year extension

The Merrimac Conservation Commission on Nov. 25 continued a public hearing for 103R River Road after the applicant failed to appear, issued a Certificate of Compliance for 146 River Rd., and granted a one-year extension for an Order of Conditions on 1 Middle Rd.
The actions were taken at a regularly scheduled meeting at the Merrimac Public Library. The commission voted unanimously on several items: 5-0 to issue a Certificate of Compliance for 146 River Rd. after Conservation Agent Jay Smith reported a site visit and receipt of an as-built and supporting documentation; 5-0 to grant a one-year extension for 1 Middle Rd. after staff confirmed paperwork and the required fee; and 5-0 to approve two vouchers for technical support. The public hearing for 103R River Road (DEP# 045-0323) was continued to the December meeting after applicant George Lay did not appear and no representative presented information.
The meeting packet shows the 103R River Road item listed as a continued Notice of Intent for site cleanup and exploratory test pits; the commission noted that Mr. Lay needed to indicate whether he or a representative would attend with sufficient notice for the public. Paul Kelly’s request for a one-year extension on the Order of Conditions for 1 Middle Rd. was approved despite Kelly’s absence; commissioners recorded that no work had commenced on the project and that the required paperwork and fee had been submitted.
A request related to a phosphorus application for Lake Attitash was raised for discussion but was tabled to the next scheduled meeting for further information. Likewise, signing of an Enforcement Order for 25 River Rd. was noted and tabled. The commission approved two vouchers for technical support, signed by the chair, and approved the meeting minutes for Nov. 25, 2024 with minor clerical changes.
Chair Jerome Mathieu moved to adjourn; Vice Chair Greg Hochmuth seconded and the motion carried unanimously. The commission set its next meeting for Monday, Dec. 16, 2024 at 6:00 p.m.
Items recorded as needing follow-up include notifying the applicant for 103R River Road that attendance or representation is required, and providing further materials or discussion on the Lake Attitash phosphorus request at the next meeting.
