Tyler Yarbrough was confirmed by the Rules, Confirmations and Public Elections Committee on July 7 after a sustained line of questioning about how he would weigh litigation risk against the city’s interest in asserting novel legal theories.
Yarbrough described his background in the public defender’s office and in private practice and said lawyers for the city should be open to creative, precedent-setting arguments while also assessing the financial and practical risks of litigation. “When we as the lawyers perceive a threat to our ability to self govern, to a threat to our values, to a threat to our way of life as Nashvillians, that should be examined,” he told committee members. He added that counsel must balance zealous advocacy with an assessment of litigation risk, noting ethical and fiscal considerations.
Committee members asked how he would communicate changing legal advice over time and how that would affect council decision-making; Yarbrough said clear communication about the reasons advice changes is part of the lawyer’s duty.
