The official explained that inaction by the Department of the Interior can lead to an automatic fee-restricted determination under the administrative timeline and that the town is preparing options, including potential judicial review, while trying to arrange cooperative discussions with the Nation.
The official said the Nation has publicly described its proposed use as diversification rather than additional gaming, naming an indoor lacrosse facility as an example of possible development. Board members were told this is an evolving, limited-case legal pathway with minimal precedent; the town will continue to seek documentation and evaluate remedies.
Members emphasized preparedness and outreach: the board will follow any procedural notices, meet with town staff to track developments, and seek updates to present to residents should the federal paperwork arrive. The official noted that the status does not end local rights to seek review or negotiation.
The board did not take a formal vote on the matter during this session; members asked for continued updates and for staff to report back when the DOI response to the FOIA arrives.
