Interim City Manager Josh Hansen presented a proposed interlocal agreement between the City of Sydney and Sydney Regional Medical Center that lays out each party’s responsibilities for payment when individuals in police custody receive medical services.
Hansen said staff reviewed Nebraska Revised Statutes 47‑702 and 47‑703 and determined that hospitals must first seek payment from the patient or insurance and that, in cases where injury occurs during apprehension, responsibility initially rests with the apprehending agency. He told council the agreement was reviewed by the city attorney and SRMC counsel and recommended that staff be authorized to proceed and return an updated version.
Council asked clarifying questions about liability for intoxication or detox needs; Hansen and City Attorney Kendra Stroman said the statutory responsibility is limited to injuries sustained during apprehension, not medical needs such as detox unrelated to an arrest injury. A motion to approve the interlocal agreement was made and the council recorded votes; one council member verbally indicated an abstention during roll call.
Hansen said recent medical invoices total approximately $7,544 and that long‑term costs are uncertain because Cheyenne County previously covered such expenses. He told council staff will budget for potential ongoing costs in the next fiscal year.
