Aldermen approve acceptance and warranty for Forest Park Plat 1 infrastructure

The Ashland Board of Aldermen voted to accept streets and stormwater infrastructure in Forest Park Plat 1 and to authorize the mayor to sign a subdivision warranty agreement that will release the developer's $25,000 construction bond and begin a three-year warranty period.

Public Works staff told the board that most construction work is complete but cited remaining minor grading and vegetative work in the detention basin separating Phase 1 and Phase 2. "Acceptance of this infrastructure would trigger the beginning of the 3 year warranty period," staff said, meaning the developer will be responsible for identified repairs during that time.

Staff said Powers Construction had previously posted the bond as a condition to proceed with phase 2, and the developer has purchased a $1,000 yard bond to cover remaining vegetative work. Board members asked about lingering homeowner complaints regarding standing water in a basin; staff said the pond is private property and that foundation and pool drains on neighboring lots have complicated finish work but expressed confidence the developer will complete repairs as weather allows.

After discussion, a motion to approve Council Bill 2024-38 passed by voice vote. On second reading, Ordinance No. 1496, which authorizes the mayor to execute the same subdivision warranty agreement, also passed by recorded 'Aye' votes from multiple aldermen.

The ordinance and warranty take effect as adopted and will require staff monitoring of warranty repairs and potential follow-up if defects persist after the warranty period.
