Mountainside council introduces amendments to tree-protection rules; hearing set for Oct. 15

On Sept. 17 the Borough Council of Mountainside introduced Ordinance 1333-2024 to amend tree protection provisions in Chapter 22, Article 13 of the Borough Code.
The ordinance revises Article 1304(b)(6) to specify acceptable measures for replacing destroyed or removed trees: replacement on the same property, replacement on another borough property, or payment of a fee to the Borough Tree Fund if replacement is not possible. It also makes procedural changes to Article 1304, including adding a provision to allow decision-making about which replacement options in an application are to be implemented and re-numbering and re-designating subsections as described in the ordinance language. Councilman Dierkes moved the ordinance and Councilwoman Wass seconded; the measure passed on first reading with a unanimous roll call and was ordered advertised for public hearing on Oct. 15, 2024.
Because the ordinance is at first reading, the amendments are not yet final; the Oct. 15 hearing will be the next opportunity for public comment and any final council action. The ordinance states it will take effect immediately upon final passage and publication as required by law.
