Council tables East Beach Club operations agreement after boundary, storage and termination concerns

On Sept. 10 the council reviewed a proposed operations agreement with the East Beach Club intended to codify longstanding beach operations (chairs, overnight storage, commercial activity and vehicle access) that have occurred informally for decades. The proposal seeks to align club practice with three town ordinances covering vehicular beach access, overnight storage and commercial activities.
Council members raised multiple practical and legal concerns. Council member Farrell (speaker 8) noted the exhibit map’s proposed western boundary appears to extend over private property and recommended pulling the line back to the existing club-owned property; he also suggested clarifying the agreement’s termination language so that an abrupt cancellation would not leave the club unable to operate temporarily. Several council members and club representatives discussed KICA ownership of some beach parcels and the need to secure KICA’s formal consent for use of those areas.
Council member Heidingsfelder (speaker 2), a club member, urged the town to clarify buffer distances and storage limits, questioned the practical effect of a 25‑yard buffer noted in the draft, and suggested eliminating beach storage boxes. Staff (speaker 6) explained parts of the mapped area lie on property KICA has historically allowed the club to use informally and that the town lacks a separate formal agreement with KICA for that location.
Given the unresolved boundary, storage and termination concerns, the council voted to table the matter and requested that staff and the club meet to revise the agreement for council reconsideration next month.
