Town approves Polo Club 5‑acre waiver and $2.86 million WWTP security for 242‑unit project

The Town Board on Oct. 15 approved key development permissions for the Polo Club project, which received Conditional Final Approval from the Planning Board for a 242‑unit garden apartment complex with a senior density bonus.
Town engineering representatives described the project’s site plans and a Stormwater Pollution Prevention Plan (SWPPP) that requests a waiver from the 5‑acre disturbance limit because certain areas require substantial cuts and fills to reach final elevations. The applicant proposes phased construction to limit concurrent disturbance, and the SWPPP includes enhanced erosion and sediment controls, additional inspections and a draft Notice of Intent (NOI) to be filed with the New York State Department of Environmental Conservation that will indicate the need for a waiver. The board approved the 5‑acre waiver request.
Separately, the board approved a revised cost estimate for the project’s privately owned wastewater treatment plant and set the required WWTP performance security at $2,860,000, based on a review by municipal engineering consultants MHE. Town staff noted that, in accordance with Town Code, a maintenance bond will be required prior to release of construction securities and that ownership and operating plans for any private system must be approved by the Town Board.
Patrick Hines, a representative for the Town Engineer, told the board that the SWPPP and site plans commit to monitoring and phasing to minimize the area and duration of soil disturbance and include additional inspection requirements. The board’s approvals carry conditions in line with Planning Board requirements and state permitting processes overseen by NYSDEC.
The Polo Club project also includes a set‑aside for 27 senior units within the 242 total units. The approvals on Oct. 15 were procedural (waiver and security amount); final construction and operational approvals remain contingent on filing the NOI with NYSDEC, securing required permits and posting the maintenance bond when the project is complete.
