Roundup: six other rezoning and modification requests heard at South Fulton CZIM

2300 Flat Shoals Road: An applicant said an existing single-family home was converted to two units in 2020–21 without proper permits and seeks rezoning from AG-1 to R-6 to legalize a duplex on 2 acres. The applicant said the work was already completed and the request aims to bring the property into compliance.
54400 Old National Highway (Z26-018): Dwayne Parish proposed a rooftop restaurant and lounge by converting and clipping the east side of a former bank building and adding roughly 5,200 square feet (applicant estimated 52 parking spaces). Parish said typical hours would be about 7 a.m. to 2 a.m. daily and that amplified music (karaoke) would be part of the operation; staff and attendees asked about parking and noise windows.
Z26-019 / U26-009 (Circle K and QSR pads): Nazar Alibai (Alibai Energy) described a request to rezone 1.97 acres from C-1 to C-2 for a Circle K convenience store with roughly six MPDs, two quick-service restaurant pads and EV charging (applicant said a Tesla-branded charger was planned). He said GDOT is reviewing whether a deceleration lane will be required and that the site is not in a floodplain.
M26-003 Bethlehem Road: Jeffrey Peters (Elite Engineering) representing Monarch Luxury Builders asked to remove a 100-foot undisturbed perimeter buffer for a roughly 91.6-acre, 146-lot subdivision (disturbing about 54.2 acres in phases). Peters said the modification would not create new lots beyond remediation of certain platted lots and that the project would replant a higher number of tree units than removed.
M24-004 adult day care modification: Mariah asked to amend a zoning condition to allow either adult day services or child care at an existing facility (not simultaneously). Community commenters identified local demand for adult day services for people with disabilities; staff said licensing follows state guidance and the city would reflect that in staff reports.
M26-005 auto sales modification (5120 Cascade Palmetto Hwy): Shavar Brown (6 15 Auto Group) requested removal of a 1978 limitation to allow automobile sales on a 1.53-acre site, estimating 50–75 cars on a gravel lot and 7–10 jobs. The applicant said the property transitioned from Fairburn to South Fulton jurisdictionally.
In all cases staff noted these are early-stage presentations: detailed staff reports, parking analyses, traffic studies and required public participation documents will be developed before planning commission and council hearings; staff reiterated deadlines for public participation and hearing dates.
