The East Hampton Zoning Board of Appeals on July 7 granted a natural resources special permit and a 14.2‑foot variance from the bluffcrest setback for 24 Cross Highway in Amagansett, allowing a horseshoe‑shaped driveway for the property.
Member Merrin and other board members said the variance addressed a genuine site difficulty: a narrow right‑of‑way and an existing nonconforming garage left no safe or practical alternative for parking. Member Merrin said she did not view the 19% variance as substantial in context and pointed to mitigation including two dry wells and removal of a nonconforming shed.
"Given the preexisting nonconformity of the existing garage and what is a particularly narrow right of way...I do not see this difficulty at all to be self created," Merrin said. Member Berger and Member Kiley also supported approval and noted the applicants had positioned the driveway to avoid major tree removal.
The board approved the NRSP and the variance, recording proposed mitigation measures (dry wells and removal of a nonconforming shed) and the requirement that plans follow the approved mitigation. The decision included references to NRSP and variance standards in the town code.
