The Lakehurst Land Use Board sent a recommendation to the governing body urging amendment of the borough cannabis ordinance to eliminate an option for a third cannabis retailer in the B‑2 Highway Business Zone west of Lake Street, citing market capacity and suitability concerns.
At the May 7 meeting, Land Use Board Chairman Dave Burton said the board dismissed the third‑store application without prejudice and warned that a third retailer would not be feasible in the zone. "If they have not found a location by now, they will not find one," Burton said.
Borough Attorney Ian Goldman told council members the applicant holds a Letter of Intent with the borough and that any modification to that LOI or the ordinance would require a formal review by the governing body in collaboration with the Cannabis Committee. "It is my job to reduce the risk of exposure," Goldman said, framing the legal caution around changes to the existing agreement.
No formal ordinance amendment was introduced at the meeting. The exchange leaves the decision to the mayor and council, who must weigh the Land Use Board’s recommendation, the applicant’s LOI and any input from the borough Cannabis Committee before changing permitting options in the B‑2 district.
