Rolla City Council approves rezoning, alley vacation, animal shelter contract and multiple public-works bids

The Rolla City Council met May 5 at Rolla City Hall and approved a series of land-use and public-works measures, including rezoning 21 Stephendale Court, vacating an alley north of 18th Street and authorizing a contract for masonry work at the new animal shelter. Most motions passed unanimously; one paving award passed 10-2.
City Counselor Nathan Nickolaus read Ordinance 4856 for a final vote to rezone 21 Stephendale Court from R-1 (suburban residential) to C-1 (neighborhood commercial). The motion to approve, made by Councilman Steve Jackson and seconded by Councilman Nathan Chirban, passed by roll call 12-0.
Nickolaus then read Ordinance 4857 to vacate the remainder of an alley in Schuman’s Addition north of 18th Street between Oak and Elm Streets. Councilman Mattias Penner moved and Councilwoman Tina Balch seconded the motion; the roll-call vote was 12-0 in favor.
Council also approved Ordinance 4858 to enter into an agreement with BuildTec Construction LLC for Project 541, New Animal Shelter – Phase 2B Kennel Masonry. The motion, moved by Balch and seconded by William Hahn, passed on roll call 12-0.
On procurement and capital projects, Council awarded a bid for Project 570 (Soest Road ADA Improvements) to Donald Maggi, Inc.; the motion by Councilman Nathan Chirban carried by voice vote 12-0. For Project 600 (2025 Concrete Paving), Council awarded the contract to Donald Maggi, Inc. despite an irregularity: a cashier’s check from Barry Krause LLC was submitted where a bid bond had been required. Council voted to waive the irregularity and award the work; the vote was 10 Ayes, 2 Nays (Councilwoman Tina Balch and Councilman Nathan Chirban opposed).
The council approved repairs to pickleball courts damaged by a tornado. Parks Director Floyd Jernigan presented bids; McConnel & Associates was approved for net, posts and surface repairs at $39,470 and All Type Fence was approved for fencing and windscreen replacement at $33,965. The motion passed by voice vote 12-0.
Administrative actions included a motion to authorize City Administrator John Butz to sign the Sovereign Immunity Preservation Rider to satisfy insurer requirements; the motion passed by voice vote 12-0. Council heard a first reading on an agreement with HDR Engineering to update the city’s Integrated Management Plan, an update required every five years under a 2018 MOU with DNR; that ordinance was introduced for first reading only and did not receive a final vote at the meeting.
During citizen communications, Ward 2 resident Collin Gentry asked that city boards be updated online. David Dukes urged the council to make gambling machines illegal and cautioned the council about McBride Homes, referencing a multi‑million‑dollar lawsuit in St. Louis; staff noted there is a pending state bill that could legalize such machines.
In personnel business, the council postponed an appointment of John Jamison to the Planning & Zoning Commission until the May 19 meeting when Mayor Magdits is expected to be present. Reappointments of Dr. Janice Martin and Monty Sheild to the Planning & Zoning Commission for four-year terms were approved 12-0. By paper vote, the council selected Aaron Pace and William Hahn as its representatives to the Chamber’s Destination Rolla Grant Committee for one-year terms.
The meeting closed with routine announcements about community events and the next council meeting set for May 19, 2025. No closed-session items were reported under RSMo 610.021; the meeting adjourned at 8:02 p.m.
