Board withdraws planned butterfly-installation locations after contract and liability concerns

The Greenwood parks board voted on July 7 to withdraw previously designated locations for a butterfly-installation project after staff reported concerns about contract terms and the city’s ability to hold the installing party to maintenance and liability obligations.
Staff said follow-up questions revealed that if the project were contracted solely with Old Town Greenwood, the city would lack contractual recourse. "We discovered based off of the questions... that if we contract it solely with the MAGO or Old Town Greenwood, we as a city would have no recourse," a staff member told the board, citing maintenance, liability and scheduling as the reasons.
Because of those concerns, staff recommended the board reconsider the locations and withdraw the set-aside sites so the city can pursue a contracting structure that provides recourse (staff suggested contracting with the county would be necessary to achieve that). The board voted to withdraw the contracts on a motion by Mr. Berg, seconded by Mr. Dietrich; votes were recorded as aye by Mr. Berg, Mr. Dietrich, Miss Williams and the chair.
The board's action removes the city’s commitment to those specific butterfly-installation locations; staff said it will adjust the procurement approach to ensure maintenance responsibilities, liability coverage and scheduling are contractually enforceable before reassigning sites.
