Council amends land-use ordinance to shift sidewalk-waiver authority from TRC to planning board recommendation

The Edison Township Council on Jan. 14 approved an amendment to a proposed land-use ordinance that removes final sidewalk-waiver authority from the Technical Review Committee (TRC) and makes the TRC a recommending body to the planning board.
The attorney to the council told members the published draft contained an error and recommended an amendment so that "the TRC will then make a recommendation as to sidewalk waivers to the planning board, not continue to possess the authority to make that waiver on their own," a change the council adopted by roll call. After approving the amendment, the council introduced the amended ordinance for first reading and set a public hearing for Jan. 28, 2026.
Council discussion focused on process and timing. One councilor supported the change as a streamlining step, saying shifting the TRC to a recommendation role would help applications move more quickly and ensure sidewalks are built with new redevelopment that benefits schoolchildren and pedestrians. Another councilor raised a procedural concern that removing board representation from the TRC could lengthen some projects if planning or zoning boards later request additional studies such as traffic analyses.
The attorney responded that the TRC, as revised, is intended to be a preliminary checklist to confirm applications are complete and in compliance; it would recommend next steps to the planning board, which retains authority to require further studies or conditions. "So to your point, if a specific project the planning board required a traffic study that wasn't otherwise required, the technical review committee may recommend that they might want to get a traffic study, but it'd be the planning board who would have to require it," the attorney said.
Roll call on the amendment recorded affirmative votes from council members in attendance; the council then voted to introduce the amended ordinance on first reading and to publish notice for a public hearing on Jan. 28, 2026.
The ordinance description read into the record amends chapter 39 of the township land-use code (section 39-12.15) to change the TRC's authority. The attorney and councilors said they will monitor the impact of the change and can revisit the ordinance if it creates delays in the development-review process.
The council did not take final adoption action on the ordinance at the meeting; it will return for a public hearing and potential final vote on or after the Jan. 28 public hearing.
