Mayor Laura Arnold told the council the decision followed unanimous votes taken in a closed session earlier in the evening. "The council unanimously authorized the city manager to go forward with litigation against AM Pyrotechnics," she said, and added the council also authorized litigation to recover contractual funds from a former employee.
Council members and staff previously described how the vendor's default forced Parks & Recreation, the fire department and police to work in concert to secure a replacement and keep the holiday celebration intact. The council did not discuss litigation details in open session and said the action was authorized by a closed-session vote.
Next steps: the city manager's office will coordinate with the city attorney on legal filings to recover damages and any contractual losses related to the vendor's cancellation.
