Valerie MacFarlane described buying a home in 2011 that included a preexisting pool screen enclosure; when she sought to replace the aged screen she was told the feature encroached into a utility easement and various permitting comments had been missed in prior reviews. Council members and staff acknowledged procedural gaps and voted to approve the variance, waive the future building permit fee and refund the applicant's $500 variance fee as restitution for time and expense.
Separately, the council considered a variance for a pole barn at 1521 Toy Street, where the accessory structures were larger than the principal dwelling and built without a permit. The applicant presented engineering plans and neighbors testified they had no objection; council approved the variance and required the applicant to complete the permit inspections and any required engineering fixes.
Council members used both cases to emphasize staff is working to streamline permitting and to avoid placing residents through repeated hearings for errors that predated their ownership.
