Montague Committee adopts resolution opposing state ADU mandate; members debate local control

On April 22 the Montague Township Committee adopted Resolution 2025-053 opposing proposed state legislation that would permit accessory dwelling units (ADUs). The resolution passed by a 4–1 vote: Mr. Innella, Mr. LeDonne, Mr. Merusi, and Mayor Zitone voted in favor; Ms. Holstein opposed.
Ms. Holstein said she did not believe the resolution would infringe upon local authority and characterized it as enhancing property owners’ rights. Other Committee members, supported by Municipal Clerk Dana Klinger, expressed concern the resolution was necessary because the state mandate would substantially reduce local control and preempt existing local ordinances that largely prohibit ADUs in Montague.
Clerk Klinger noted that the New Jersey League of Municipalities supports opposition to the state-mandated legislation referenced in the resolution. Committee members recorded differing views on whether the resolution was defensive of local zoning authority or primarily protective of property owners’ flexibility; the motion passed with a majority vote.
