Commission approves Publix site plan, agrees to park conveyance and TDR contribution for preservation

The City Commission voted to approve ordinance and site-plan amendments allowing a planned redevelopment that will include a new Publix supermarket and the conveyance of a 20,000-square-foot park to the city. Mario Garcia Serra, counsel for Publix, told the commission the company will convey the park in fee simple and provide 35,000 square feet of development rights to the city to support historic-preservation programs.
Planning staff reported revisions were made to address flood-zone base elevations and timing of off-site traffic and bicycle improvements that require Miami-Dade County approvals. The applicant agreed to finalize evidence of withdrawal notices and to meet other conditions of approval; commissioners asked staff to ensure the conveyance and any deed restrictions require the green space be maintained in perpetuity as parkland.
Commissioners praised the negotiated package and highlighted the potential public benefit from the park site in the downtown area. The commission approved E3/E7 on second reading after staff confirmed the updated conditions of approval were provided to commissioners.
Next steps: city attorney and staff will complete the conveyance documentation and return any development-rights sale plan and deed agreements for final action. Planning staff will track required county approvals and ensure off-site roadway/bike commitments are met before final construction permits are issued.
