The Johnstown Planning Board on July 7 reviewed a proposal from Victory Homes USA to finish the conversion of a fire‑damaged two‑family at 304 N. Perry Street into a four‑unit dwelling and scheduled a public hearing on the matter for Aug. 4, 2026.
City staff told the board the property’s current zoning permits one‑ and two‑family residential use only, so converting the building to four dwelling units would constitute a multi‑family use and requires a variance from the Zoning Board of Appeals. Code Enforcement noted that the building already has a new roof, updated electrical wiring and four electrical panels installed.
The parking plan shown on submitted documents lists four spaces; Planning staff explained that the ordinance requires 1.5 spaces per dwelling unit. The applicant said there are two additional spaces in front of the home currently used for parking, and Codes advised that the extra spaces would be acceptable for the conversion as proposed. The board determined a SEQR review was unnecessary based on the scope of the project and that no County Planning Board referral is required.
The City Clerk, Carrie M. Allen, was directed to forward the application to the Zoning Board of Appeals and to arrange a ZBA meeting on Aug. 16, 2026, provided a quorum is available. Final site plan approval will be considered only after completion of the zoning variance process and the scheduled public hearing.
Planning Board member Terri Easterly announced an abstention from any vote on this property due to involvement in the property's real estate transaction; the board recorded that statement in the minutes.
