Board allows small rear addition at 280 Maynard Road under existing comprehensive permit

The Sudbury Zoning Board of Appeals on June 1 approved a modification to an existing Chapter 40B comprehensive permit that will allow a one‑room addition at 280 Maynard Road.

Owner Hayley Sachs told the board the small rear addition is intended to create a safer first‑floor space for her youngest daughter, Harper, who has developmental delay and epilepsy. Board counsel and members discussed whether the change was a “substantial” alteration to the prior three‑unit affordable housing permit or an insubstantial modification handled under the comprehensive permit rules. Counsel Adam Burney and board member Ian Henchy advised the board that the relief granted in the original comprehensive permit was broad and that the proposed change does not alter the underlying use or add units.

Board members examined whether a separate variance hardship test was required; the town’s counsel and a board majority concluded it was not. Sumeet Keswani raised whether the addition violated the spirit of the setback rule because of an existing shed; Sachs offered to remove or relocate the shed if necessary. Keswani moved to approve the modification and Pincus seconded. The roll‑call vote was unanimous: Riepe, Dorjets, Henchy, Pincus and Keswani all voted Aye.

The board’s action treats the one‑room addition as an insubstantial modification under the existing comprehensive permit; any related site changes (such as relocation of the shed) would be coordinated with staff as needed.
